The Site is a free, public listings board for jobsite materials and services such as dirt, aggregate, and concrete. Users post listings to indicate that they have a material to give away or sell, or that they need a material. The Site is a venue only. The operator is not a party to any transaction between users.

The Site may offer Book a Haul, a channel to submit a haul request or discuss hauling needs with the operator. That feature is for facilitated marketplace matching and introductions only. The operator is not a motor carrier, freight broker, dispatcher, logistics operator, or guarantor of haul performance.

Any hauling, pricing, schedule, insurance, safety, or payment is arranged directly between you and independent third-party providers. The operator does not employ carriers, operate trucks, hold haul payments in escrow, or verify carrier credentials, insurance, or regulatory status unless explicitly stated elsewhere in writing signed by the operator.

You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction. By using the Site you represent that you meet these requirements.

When you post a listing or otherwise submit content (collectively, "User Content"), you represent and warrant that:

  • the User Content is accurate, current, and complete to the best of your knowledge;
  • you have the right to post the User Content (you own the photo, you have authority to dispose of the material, etc.);
  • the User Content complies with our Acceptable Use Policy and with applicable law;
  • you understand that the User Content will be publicly visible on the internet, including contact details you choose to include.

You retain ownership of the User Content you submit. You grant the operator a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute the User Content for the purpose of operating the Site. This license ends when you remove the listing, except that the operator may retain backup copies for a reasonable time.

When you post a listing, the Site generates a one-time manage code and shows it to you. The operator does not retain a copy of the plaintext code - only a one-way hash. Anyone holding your manage code can edit or delete your listing. Treat it like a password: do not share it.

The operator may, at any time and without notice, modify, remove, or refuse to publish any listing or other User Content that the operator believes (in good faith) violates these Terms, the Acceptable Use Policy, or applicable law, or is otherwise harmful to the Site or its users. The operator may also discontinue the Site or any feature of it at any time.

The operator does not verify the identity of users, the truth of any listing, the safety or quality of any material, the legitimacy of any address, or whether anyone listed actually owns the material they claim to be moving. You alone are responsible for vetting any party you find on the Site before transferring money, accepting material, or sending equipment to a site.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages. In those jurisdictions, the limits above apply only to the maximum extent permitted.

You agree to indemnify, defend, and hold harmless the operator from and against any third-party claim, damages, liability, cost, or expense (including reasonable attorneys' fees) arising from (a) your User Content, (b) your use of the Site, (c) your breach of these Terms or the Acceptable Use Policy, or (d) your violation of any applicable law or any third-party right.

If you believe a listing on the Site infringes your copyright, submit a notice through our contact form (subject: Copyright (DMCA) notice) with the following information, in accordance with 17 U.S.C. ยง 512(c)(3):

  1. your physical or electronic signature;
  2. identification of the copyrighted work claimed to be infringed;
  3. the URL of the listing you claim is infringing (so we can find it);
  4. your address, telephone number, and email address;
  5. a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices in accordance with the DMCA. The operator's designated copyright agent is listed on the Contact page.

To report a listing that you believe is illegal under applicable law, fraudulent, or otherwise violates the Acceptable Use Policy, use our contact form with the listing URL and a brief description of the problem. We will review and respond.

The operator may suspend or terminate your access to the Site at any time, with or without notice, for conduct that the operator believes (in good faith) violates these Terms. You may stop using the Site at any time and delete your listings via your manage code.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. You and the operator agree to submit to the exclusive jurisdiction of the state and federal courts located in Colorado for any dispute arising out of or relating to these Terms or the Site.

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date in the hero above. Your continued use of the Site after we post changes is your acceptance of the updated Terms.

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. These Terms, the Privacy Policy, the GDPR Information page (for EU/UK visitors), and the Acceptable Use Policy together form the entire agreement between you and the operator regarding the Site.

If you provide your mobile number and agree to receive texts, Jobsite Exchange, LLC may send you SMS messages about haul requests and listings you initiate - coordination and status updates, listing inquiry notifications, account and listing-management notices, and one-time verification codes you request. Consent to receive texts is not a condition of using the Site or of any purchase.
